- Market Insights: Locality trends, hidden cost calculations, and investment analysis
- Premium Reports: Detailed valuation reports available for purchase
3.2 Service Limitations
Users acknowledge and agree that:
- • BannaAI is an INFORMATION PLATFORM, not a real estate broker, agent, or valuer
- • We do not facilitate property transactions directly
- • AI valuations are INDICATIVE ESTIMATES and not certified appraisals
- • Property listings are sourced from third parties and may not be verified by BannaAI
- • We do not guarantee the accuracy, completeness, or availability of any property
4. Eligibility
To use our Services, you must:
- a) Be at least 18 years of age
- b) Be capable of entering into a legally binding contract under Indian law
- c) Not be prohibited from using the Services under any applicable law
- d) Provide accurate and complete information during registration
- e) Have a valid Indian mobile number for WhatsApp services
5. User Account and Registration
5.1 Account Creation
To access certain features, you may need to register by providing your WhatsApp number and basic information. You agree to:
- • Provide accurate, current, and complete information
- • Maintain the security of your account credentials
- • Promptly update any changes to your information
- • Accept responsibility for all activities under your account
5.2 Account Security
You are solely responsible for maintaining the confidentiality of your account. Notify us immediately at contact@bannaai.com if you suspect unauthorized access.
6. Fees and Payment
6.1 Free Services
Basic property search and standard AI valuations are provided free of charge.
6.2 Premium Services
Premium services, including detailed AI Valuation Reports, are available for purchase:
Prices are inclusive of applicable taxes. We reserve the right to modify pricing with prior notice.
6.3 Payment Terms
- • Payments are processed through secure third-party payment gateways
- • We do not store your payment card details
- • All payments are in Indian Rupees (INR)
- • GST invoices will be provided for all paid services
6.4 Refund Policy
- • Premium reports, once generated and delivered, are non-refundable
- • In case of technical issues preventing report delivery, a full refund will be processed within 7-10 business days
- • Refund requests must be made within 48 hours of purchase

7. AI Valuation Disclaimer

- • NOT suitable for use in legal proceedings, loan applications, or official purposes
- • Subject to limitations inherent in AI/ML models and available data
7.2 Accuracy Statement
While our AI model achieves high accuracy on training datasets, actual property values may vary significantly due to:
- • Unique property characteristics not captured in data
- • Recent market fluctuations
- • Local micro-market conditions
- • Legal encumbrances or title issues
- • Physical condition of the property
7.3 User Acknowledgment
By using our AI valuation services, you acknowledge and agree that:
- a) You will NOT rely solely on BannaAI valuations for purchase/sale decisions
- b) You will conduct independent due diligence and seek professional advice
- c) BannaAI is NOT liable for any financial decisions based on our valuations
- d) For legal or banking purposes, you will obtain certified valuations from registered valuers
8. Real Estate Regulatory Disclaimer
8.1 RERA Compliance
BannaAI operates as a technology platform providing information services. We are NOT:
- • A registered real estate agent under RERA (Real Estate Regulation and Development Act, 2016)
- • A real estate broker or intermediary
- • A property developer or promoter
8.2 Property Listings
Property information displayed on our platform:
- • Is sourced from third-party providers, public records, and user submissions
- • May not be verified for accuracy by BannaAI
- • Should be independently verified by users before making any decisions
- • May include properties that are RERA-registered or non-RERA registered
8.3 User Responsibility
Users are advised to:
- • Verify RERA registration status of any property/project before investment
- • Check builder/developer credentials independently
- • Consult legal professionals for property transactions

9. User Conduct and Prohibited Activities
You agree NOT to:
- a) Use the Services for any unlawful purpose or in violation of these Terms
- b) Provide false, misleading, or inaccurate information
- c) Impersonate any person or entity
- d) Attempt to gain unauthorized access to our systems
- e) Use automated tools (bots, scrapers) to access the Services
- f) Interfere with the proper functioning of the Services
- g) Copy, reproduce, or distribute our content without permission
- h) Use our Services to spam, harass, or harm others
- i) Circumvent any security measures or access restrictions
- j) Use AI valuations for purposes other than personal information
10. Intellectual Property
10.1 BannaAI's IP
All intellectual property rights in the Services, including but not limited to:
- • Software, algorithms, and AI models
- • Website design, logos, and branding
- • Content, reports, and analysis
- • Trade secrets and proprietary methodologies
are owned by or licensed to BannaAI and protected under Indian and international IP laws.
10.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms.
10.3 User Content
By submitting any content (queries, feedback, property information) to BannaAI, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, and incorporate such content for improving our Services.
11. Third-Party Services
Our Services may integrate with or link to third-party services including:
- • WhatsApp (Meta Platforms)
- • Payment gateways (Razorpay, etc.)
- • Property data providers
- • Analytics services
Your use of such third-party services is subject to their respective terms and privacy policies. BannaAI is not responsible for third-party services.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
a) THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
b) WE DO NOT WARRANT THAT:
- • The Services will be uninterrupted, secure, or error-free
- • Property information will be accurate or complete
- • AI valuations will reflect actual market values
- • The Services will meet your specific requirements
c) WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
a) BANNAAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
b) OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO BANNAAI IN THE 12 MONTHS PRECEDING THE CLAIM, OR INR 10,000, WHICHEVER IS LOWER
c) WE ARE NOT LIABLE FOR:
- • Decisions made based on AI valuations or property information
- • Financial losses from property transactions
- • Inaccuracies in third-party property data
- • Service interruptions or data loss
- • Actions of other users or third parties
14. Indemnification
You agree to indemnify, defend, and hold harmless BannaAI, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- a) Your use of the Services
- b) Your violation of these Terms
- c) Your violation of any third-party rights
- d) Any content you submit to the platform
- e) Your property transactions or investment decisions
15. Termination
15.1 Termination by User
You may stop using our Services at any time. To delete your account, contact us at contact@bannaai.com.
15.2 Termination by BannaAI
We may suspend or terminate your access to the Services:
- • For violation of these Terms
- • For fraudulent or illegal activity
- • For extended inactivity
- • At our discretion with or without notice
15.3 Effect of Termination
Upon termination:
- • Your right to use the Services ceases immediately
- • Provisions that should survive (IP, Liability, Indemnity) will remain in effect
- • We may delete your data in accordance with our Privacy Policy
16. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Material changes will be notified via:

18. Dispute Resolution

18.2 Arbitration
If informal resolution fails, disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator in Ahmedabad, Gujarat, in English.
18.3 Exceptions
Either party may seek injunctive relief in courts for IP infringement or data breaches without first pursuing arbitration.
19. General Provisions
19.1 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and BannaAI regarding the Services.
19.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
19.4 Assignment
You may not assign these Terms without our written consent. We may assign these Terms freely.
19.5 Force Majeure
BannaAI shall not be liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures.
